1. Agreement to Terms

Welcome to DreamLens Mobile. These Terms of Service ("Terms") constitute a legally binding agreement between you and SBK Soft ("we," "us," or "our") governing your use of the DreamLens Mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use DreamLens Mobile. By using the App, you represent and warrant that you meet this age requirement.

2.2 Legal Capacity

You must have the legal capacity to enter into these Terms. If you are under 18, you must have permission from a parent or legal guardian to use the App.

2.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3. Description of Service

DreamLens Mobile is a digital dream journal application that provides:

  • Dream recording and organization features
  • AI-powered dream analysis and insights
  • Audio recording capabilities for voice-to-text dream entries
  • Image attachment for visual dream elements
  • Dream statistics and patterns tracking
  • Mood and emotional state tracking
  • Push notifications for dream reminders
  • Premium features through in-app subscriptions

4. Account Registration and Security

4.1 Account Creation

You may create an account using:

  • Email and password
  • Google Sign-In
  • Facebook Login

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

4.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • Your account has been inactive for an extended period
  • We are required to do so by law

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the App to:

  • Record and organize your personal dreams
  • Access AI-powered dream analysis
  • Track dream patterns and statistics
  • Use voice recording and image features
  • Receive notifications and reminders

5.2 Prohibited Content

You agree NOT to create, upload, or share dream entries that contain:

  • Illegal content or activities
  • Hate speech, discrimination, or harassment
  • Violence, threats, or incitement to harm
  • Sexual exploitation or abuse
  • Content that violates intellectual property rights
  • Spam, malware, or malicious code
  • Content that violates any applicable law

5.3 Content Moderation

We reserve the right to:

  • Review dream content that is flagged or reported
  • Remove content that violates these Terms
  • Suspend or terminate accounts that repeatedly violate our policies
  • Report illegal content to appropriate authorities

Dreams containing prohibited content will be rejected and may result in account suspension or termination.

5.4 Prohibited Activities

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any commercial purpose without authorization
  • Attempt to gain unauthorized access to our systems
  • Use automated means to access the App (bots, scrapers)
  • Interfere with or disrupt the App's functionality
  • Impersonate another person or entity
  • Collect or harvest user data without permission

6. Intellectual Property Rights

6.1 Your Content

  • You retain all ownership rights to your dream entries and content
  • By using the App, you grant us a limited license to:
    • Store and process your dreams for providing services
    • Generate AI analysis of your dreams
    • Display your content back to you within the App
  • We do not claim ownership of your personal dream entries

6.2 AI-Generated Content

  • AI-generated dream analyses are licensed to you for personal use
  • We retain intellectual property rights to the AI models and algorithms
  • You may not redistribute or commercialize AI-generated insights

6.3 App and Services

All rights, title, and interest in the App, including:

  • Software code and architecture
  • Design elements and user interface
  • Logos, trademarks, and brand elements
  • AI models and algorithms
  • Documentation and materials

remain the exclusive property of SBK Soft.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you.

7. Subscription and Payments

7.1 Subscription Plans

We offer the following subscription options:

  • Monthly Subscription: Billed monthly
  • Annual Subscription: Billed annually
  • Free Trial: 3-day free trial for new subscribers

7.2 Payment Processing

  • Payments are processed through Google Play Store or Apple App Store
  • Subscription management is handled by RevenueCat
  • Prices are displayed in your local currency and may vary by region

7.3 Free Trial

  • New users receive a 3-day free trial of premium features
  • You will not be charged during the trial period
  • You can cancel anytime during the trial without charge
  • After the trial, your subscription will automatically renew unless cancelled

7.4 Automatic Renewal

  • Subscriptions automatically renew at the end of each billing period
  • You will be charged 24 hours before the renewal date
  • You can cancel auto-renewal at any time through your app store account settings

7.5 Refund Policy

We follow the refund policies of Google Play Store and Apple App Store:

  • Refund requests must be made through your respective app store
  • Refunds are subject to the app store's terms and conditions
  • We generally honor refund requests made within 48 hours of purchase if no features have been used
  • Partial refunds for monthly or annual subscriptions are not available
  • If you have concerns about charges, contact support@sbksoft.com

7.6 Price Changes

  • We reserve the right to modify subscription prices
  • You will be notified of price changes at least 30 days in advance
  • Continued use after price changes constitutes acceptance
  • Existing subscribers will maintain their current price for one billing cycle

8. Third-Party Services

The App integrates with third-party services:

  • Supabase (backend and database)
  • RevenueCat (subscription management)
  • Firebase Cloud Messaging (notifications)
  • OpenAI or Anthropic (AI analysis)
  • Google Sign-In and Facebook Login (authentication)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service performance or policies.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

10. Disclaimer of Warranties

10.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 No Medical or Professional Advice

  • Dream analyses are for entertainment and self-reflection purposes only
  • The App does not provide medical, psychological, or professional advice
  • AI-generated insights should not be used as a substitute for professional consultation
  • If you have mental health concerns, consult a qualified healthcare professional

10.3 No Guarantee of Accuracy

  • We do not guarantee the accuracy, completeness, or usefulness of AI-generated content
  • Dream interpretations are subjective and may not reflect actual meanings
  • We are not responsible for decisions made based on AI insights

10.4 Service Availability

  • We do not guarantee uninterrupted or error-free service
  • The App may be temporarily unavailable due to maintenance or technical issues
  • We reserve the right to modify or discontinue features at any time

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data or content
  • Loss of business opportunities
  • Personal injury or emotional distress

11.2 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

11.3 Jurisdictional Variations

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless SBK Soft, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your dream content or submissions

13. Data Retention and Account Deletion

13.1 Data Retention

  • Your data is retained until you delete your account
  • Dream entries are retained until you delete them individually or delete your account
  • After account deletion, all personal data is permanently deleted immediately

13.2 Account Deletion

You can request account deletion by:

  • Contacting legal@sbksoft.com with your registered email address
  • Including "Account Deletion Request - DreamLens Mobile" in the subject line

13.3 Service Discontinuation

If we discontinue DreamLens Mobile, we will:

  • Provide at least 90 days' notice
  • Allow you to export your dream data
  • Permanently delete all user data after the notice period

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Gaziantep, Turkey.

14.3 Informal Resolution

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at legal@sbksoft.com. We will attempt to resolve the dispute within 30 days.

14.4 Arbitration (Optional)

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with Turkish arbitration laws, at the mutual agreement of both parties.

15. Modifications to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective upon posting in the App.

15.2 Notification

We will notify you of material changes through:

  • In-app notifications
  • Email to your registered address
  • Updates to the "Last Updated" date

15.3 Acceptance

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and SBK Soft regarding the App and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.

19. Assignment

You may not assign or transfer these Terms or your account to any third party without our written consent. We may assign these Terms to any affiliate or successor without your consent.

By using DreamLens Mobile, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
